A professional footballer has been jailed for seven years and four months for killing two children in a crash.Former Plymouth Argyle goalkeeper Luke McCormick, 25, admitted causing the deaths of Arron Peak, 10, and Ben Peak, eight, and driving with excess alcohol.The court heard that when breathalysed McCormick was found to have 74 micrograms of alcohol in 100 millilitres of breath.
The legal limit is 35 micrograms of alcohol per 100 millilitres of breath.
The brothers, from Partington, Greater Manchester, died in a crash on the M6 in Staffordshire on 7 June.Stoke Crown Court heard McCormick had driven "like an idiot". The boys' parents said they were scarred forever.
The court also heard McCormick, who was returning from a wedding, had ignored a plea from a friend to stop driving and pull over at services. In a victim impact statement the boys' parents, Philip and Amanda Peak, said their lives had been shattered by the accident.
Philip Peak remains in a wheelchair and wears a neckbrace. He suffered spinal and lung injuries in the crash and may need further surgery.Mr and Mrs Peak said they were disappointed McCormick would be eligible for parole in three-and-a-half years' time.

Is this justice for what is effectivly Murder, and can the family find peace now he is behind bars..?

Does the fact that he could be out in less than 4 years make a mockery of the justice system..?

That's a crying shame. I don't see how those who sentenced him can sleep at night... I hope they don't!

We've got people here who have been in repeated severe crashes, gotten a few years in jail- and then go out and do it again. They just don't seem to learn. We also have people who get stopped and arrested for drunk driving- and have strong evidence they weren't drinking (and these get the book thrown at them).
My opinion- if a person drives like an idiot when drunk, they probably drive like an idiot when sober too- just get away with it more. |

As someone who's been there, I feel for the parents of those boys. Some of you already know, I lost my baby sister to a drunk driver 12 years ago this past June 18th. Peg was 26.
She was an airman 1st class in the U.S. Airforce stationed at Travis airbase in California. She worked the night shift in supply so that she could attend college during the day.
One night on her way to work, some a**hole who had decided to start drinking at 5 that evening, left a bar to head home, after drinking for some 5 or so hours straight. He hit her head on. The EMT's that responded to the call said that Peg was dead on impact, she probably never knew what hit her.
That had to be the hardest call I ever received. The Airforce, TG, took control of the whole situation, and had her body flown home here to Jersey, where they took care of all the funeral arrangements. I had her buried next to my mother, since we always thought that Peg was her favorite.
I've never gotten over this, I still have times that I break down. Time apparently doesn't heal all wounds.
To make a long story short, thanks to that guy having one good night at the bar, my sister has been gone from my life. Mary barely remembers her, since she was only 4 at the time. Bridget was 1 1/2 and has no recall, and Alice wasn't born yet, so she only has stories to go on. Not to mention the neices and nephews I could of had. I miss Peg everyday.
So 7 years and some months for some jerk who decided to have a good time and wreck someone else's family? I think he got off way too easy. Way too easy. The ass that did this to me and my family? He got 5 years, and was out in 2 1/2. I didn't have the money and I had little kids home at the time of his parole hearing, and couldn't get out to California to protest his release. So he's back on the streets to terrorize some other family.
I know because of my beliefs, that I should be able to forgive, but this one I just can't. I pray he rots in hell.
My 2 cents. Justice can never be served in a case like this.

Steve, you are right. There can not be any true justice in a situation like that.
A wound like that never really heals. The best thing for it is friends and family- and you have friends here.

In The U.K
Causing death by careless driving under the influence of drink (or drugs) = maximum 10 years in prison, driving ban of a minimum of 2 years and an unlimited fine.
So if someone is sentenced to the maximum that the U.K law allows, theoretically they could back on the road after 2 years,out of prison after 4-5, years.
The prisons are so full and over crowded. So judges tend to give less than the maximum, so if he got 7 years, this guy might be out in even less than the 3 and a half years minimum that he should serve. |

I think the friends & family we lose in life stay with us.
Drink Drivers or those who let them drive are equally guilty.
It's not like there aren't any other options - there are lots - taxi, bus, train, sleep or WALK.
Nothing will replace the lives that have been lost. |
